Michael Rosensaft, a partner in the Litigation and Dispute Resolution Practice, spoke with Compliance Week about the use of deferred-prosecution agreements (DPAs) to settle corporate criminal cases. While some have questioned the effectiveness of such agreements, Mr. Rosensaft supports DPAs as they allow the government to settle cases without lengthy, expensive trials that could be difficult to win. “I have yet to see a deferred-prosecution agreement that didn’t accomplish everything a guilty plea would accomplish, if not more,” he says.
