Katten successfully opposed a motion for preliminary injunction in the Eastern District of Missouri on behalf of Bravo Media, LLC, NBCUniversal Media, LLC and Goodbye Pictures Inc. Photographer Michael Eastman alleged copyright infringement, violations of the Visual Artists Rights Act, fraud and breach of contract in a motion for an injunction to prevent the defendants from airing an episode of the Bravo series Million Dollar Decorators. Mr. Eastman claimed that one of his famous photos was enlarged to wall size, beyond the scope of his consent, and used in a makeover of the living room of actress and model Daisy Fuentes. The court held that Eastman failed to show irreparable harm and that he was likely to prevail on the merits of his case.
