Katten will host the Media Law Resource Center California Chapter Quarterly Lunch Meeting at 12:15 p.m. on Wednesday, September 18, where partner David Halberstadter will participate in the discussion “Your Money for My Life: The Shifting Boundaries of Right of Publicity and Commercial Misappropriation.” The session will address the following questions:

  • Where does the right to control an individual’s image end, and the First Amendment begin?
  • Are all forms of expressive works treated the same?
  • What role does the right of publicity play in an era where certain celebrities describe themselves as “brands,” and sports organizations aggressively monetize their participating athletes’ images?
  • Has the industry practice of seeking clearance or life-rights in situations where such licenses were not strictly necessary shifted society’s—and the court’s—expectations over what permissions are actually required?
